Second Man Sentenced for Lecompton Jeweler Murder

PRESS RELEASE RELEASE DATE: 01/07/09 CONTACT INFO: Charles Branson Douglas County District Attorney 785-841-0211 cbranson@douglas-county.com Douglas County District Attorney Charles Branson announced today Allen Dale Smith, 37, was sentenced in District Court for his part in the April 29, 2005 murder and aggravated burglary of rural Lecompton resident Clarence David Boose, who was 77 at the time of his murder. The Honorable Michael J. Malone sentenced Smith to life in prison for the murder conviction and he gave the aggravated sentence of 136 months for the aggravated burglary conviction. The sentences were ordered to run consecutively and consecutive to any of Smith's other sentences. He will be statutorily eligible for parole after 20 years. If paroled he will have to serve the 136 months for the aggravated burglary. The case developed when the Douglas County Sheriff's Office was called to the victim's rural home by the victim's long-time dear friend. After being unable to reach the victim by telephone for a good part of the day, the friend drove from her home in Topeka to the victim's home where she found him shot to death in the kitchen. After extensive detective work by the Sheriff's Department, it was discovered Smith and his cousin Leonard W. Price had burglarized multiple homes in the rural areas surrounding Shawnee County for several days before and after Boose was killed. Mr. Boose's daughter, son, grandson and granddaughter addressed the Court regarding the impact of their father's and grandfather's murder on their and their families' lives. They spoke of his strength, wisdom and compassion for others. Smith will serve his sentence in the custody of the Kansas Department of Corrections. -30-
