Two Cases Dismissed When Victim Refuses to Testify

Hays, 20 and Lawrence resident Louis G. Galloway, Jr., 19, were dismissed without prejudice when the victim refused to testify at today's continuation of a preliminary hearing. The Honorable Robert W. Fairchild ordered the witness to testify and when the victim refused he was found in contempt of court, was arrested and taken to the Douglas County Jail. The victim will have a hearing on the issue tomorrow at 3:00 p.m. in Douglas County District Court, Division One. Charges in the cases stemmed from incidents that occurred August 23 at the mobile home park located at 3323 Iowa Street. Galloway was charged with Conspiracy to Commit Aggravated Robbery (Level 5/Person/Felony) and Attempted Aggravated Robbery (Level 5/Person/Felony). Hays was charged with Attempted Aggravated Robbery (Level 5/Person Felony), Conspiracy to Commit Aggravated Robbery (Level 5/Person/Felony) and Attempted Aggravated Burglary (Level 7/Person/Felony). The charges listed are merely accusations and the defendants are presumed innocent until and unless proven guilty. -30-
