Nichols, 31, was sentenced today in the Division Six Courtroom of the Honorable Peggy C. Kittel for the plea he entered January 4. He was ordered to serve the aggravated sentence of 165 months for Count One, Aggravated Kidnapping, 34 months for Count Two, Aggravated Sexual Battery which will run concurrent to Count One and 42 months for Count Three, Aggravated Battery which will also run concurrent to Count One. His sentence will be served in the custody of the Kansas Department of Corrections. The Judge ordered the aggravated sentence after finding the attack on the victim was on a complete stranger in broad daylight. Additionally, when he is eventually released from prison, his Aggravated Sexual Battery conviction will require lifetime post release supervision. Investigation into the case began when officers with the Lawrence Police Department were dispatched on Wednesday, June 16 at approximately 3:15 p.m. to the section of the bike/walking trail that runs between the YSI soccer fields and Clinton Lake. The call was placed by citizens who assisted the victim in freeing herself from her attacker. Officers set up a secure perimeter and were able to apprehend the suspect when he attempted to flee the area. -30-
