Kansas City Resident Sentenced for Aggravated Battery and Criminal Discharge of a Firearm

         Douglas County District Attorney Charles Branson announces Marck Edward Fristoe, Jr., 21; was sentenced yesterday for his June guilty plea to aggravated battery and criminal discharge of a firearm.  Both charges are felonies.  The Court sentenced him to serve 38 months in prison for count one and an additional 11 months in prison for count two for a total of 49 months in the custody of the Secretary of Corrections.

        The Court also ordered Fristoe to serve 36 months post release supervision upon his release from prison, to pay $771.75 in restitution and he must register as a violent offender for 15 years upon his release from prison.

        The case began when officers with the Lawrence Police Department (LPD) were dispatched to the Lawrence Community Center at approximately 1:30 a.m. on Saturday, December 21, 2013 in reference to a shooting in the parking lot.  A group of men, including Fristoe were arguing there.  As other participants in the argument started to disperse from the area, Fristoe retrieved a gun from his car and fired three times at the occupants of the exiting vehicle.  A bystander suffered a graze wound.  An off-duty LPD officer witnessed most of the incident.  He was able to follow the vehicle Fristoe left the area in until uniformed officers were able to stop it and he was able to identify Fristoe as the shooter. 

        Yesterday’s hearing was held in the courtroom of the Honorable Barbara Kay Huff.  The case was investigated by the Lawrence Police Department and was prosecuted by Senior Assistant District Attorney Amy McGowan.
